Prevention of occupational risks for household staff: Legal obligation enforceable as of 11/14/2025

As we informed you at the time of the publication of Royal Decree 893/2024, of September 10, it is mandatory for all employers of domestic workers to implement occupational risk prevention (ORP) measures for those working in their homes. This includes preparing an occupational risk assessment and adopting the resulting preventive measures (among them, providing work equipment and personal protective equipment (PPE), giving the worker preventive information and training, and offering health monitoring —medical check-up— to the worker).
After the development of a specific digital tool to carry this out by the Ministry of Labour, it is mandatory to comply with the risk assessment, the adoption of measures and the information to the worker on ORP as of next November 14, 2025.
How to carry out the ORP obligations that must be fulfilled as an employer of a domestic worker?
The Ministry of Labour already has the free digital portal “Prevención 10” in operation, through which the risk assessment must be carried out, from which the preventive measures to be adopted and the preventive information that must be provided to the worker will be obtained. Below we explain step by step the functioning of this tool:
Functioning of the INSST tool “Prevención 10”
Access
- It is available on the INSST website (there is a specific section “Domestic Service”). Through this link: https://www.prevencion10.es/
- No digital certificate is required to enter, but it is necessary to register and enter the basic data of the employer and the worker.
Guided questionnaire
- The tool asks simple questions about:

The tasks performed by the worker (cleaning, ironing, cooking, care of dependent persons, use of chemical products, etc.).

The conditions of the home (stairs, ventilation, lighting, electrical appliances, etc.).

The frequency and intensity of each task.

Automatic risk assessment

- The system identifies typical risks: falls, overexertion, contact with chemical products, burns, electrical risks, attacks from dogs/cats, etc.
- It classifies the risks as low, medium or high.
Personalized preventive measures plan
- It generates specific recommendations adapted to the case:

Ventilate when using chemical products.

Use appropriate gloves.
-
Do not climb on unstable chairs but on approved ladders.
-
Check cables and sockets.
-
Avoid lifting weights above a certain limit, etc.

Official documentation
- The tool generates a PDF document that includes:

The risk assessment.

The recommended preventive measures.

The date of issue.

- This document must be:

Kept by the employer, duly signed.
-
Delivered as a copy to the worker, duly signed.

Updated when there are important changes.

Renewal

- It must be updated whenever tasks change, home conditions change or after an incident.
- In any case, the tool allows a periodic review in a very simple way.
What ORP obligations in domestic service remain pending regulatory development for their implementation?
Apart from the preventive actions that can be executed through the “Prevención 10” portal, the regulations provide for two additional obligations, which remain pending implementation by the Public Administration:

Preventive training provided by the SEPE: This free training for domestic workers cannot be carried out until the Resolution of the State Public Employment Service is issued for the start-up of preventive training activities.

Health surveillance (medical check-up every 3 years): The regulations provide that it can be done free of charge in the public health system. Therefore, it will not be mandatory until the regulatory provisions relating to medical examinations within the framework of the National Health System are developed.
Alternatively, and on a voluntary basis, the employer may offer the medical visit to their domestic worker by contracting it through an External Prevention Service.
Home help service
In relation to home help services (SAD), the special characteristics of this activity require an assessment carried out by a risk prevention technician. The persons in charge of assessing occupational risks must carry out the assessments in on-site visits to the homes where the care activity is carried out. It will be necessary to introduce modifications in the home, with the prior consent of the owners of the home and whenever necessary to guarantee the most appropriate protection against the risks of the job, in accordance with the risk assessment. To carry out these obligations we recommend the contracting of an External Prevention Service.
